Introduction
Last updated: October 1, 2025 These Terms and Conditions govern the use, by the User, of the software services provided by WTK Automação ('Services'), including SaaS (software as a service) solutions, automation tools, integrations with third-party platforms, and related products. If you do not agree with the terms set forth in this instrument or in the Privacy Policy, do not register, access, view or use in any way the Services of WTK Automação.
1. Purpose
For the purposes of these General Terms and Conditions of Use, "User" means any individual or legal entity that accesses or uses WTK Automação services, regardless of the means used, including, but not limited to, mobile devices, tablets, personal computers, internet browsers, applications, or any other available access device or technology. The specific scope of the contracted service is defined in the contract or offer accepted by the User.
2. Eligibility and Acceptance
Use of the Services is restricted to fully capable natural persons (18 years or older, or 16 years old and emancipated), under applicable civil law, and to duly constituted legal entities, represented by those with sufficient powers to perform the act. By accessing or using the Services, the User declares to have capacity, legitimacy and means to carry out the operation, adhering fully and irrevocably to these General Terms and Conditions. By registering, the User expressly declares the truthfulness, accuracy and authenticity of all information provided, and may be held civilly and criminally liable for ideological falsehood. WTK Automação has no responsibility for the truthfulness and correctness of data entered by the User, with registration being the User's sole responsibility.
3. Description of Services
WTK Automação provides software solutions under the SaaS (software as a service) model, including automation tools, integrations with third-party platforms and related products. Access to the Services is made exclusively through the official channels indicated by WTK Automação. WTK Automação is not responsible for the policies or practices of third-party platforms integrated with the Services.
4. Acceptable Use
The User agrees to use the Services only for lawful purposes and in accordance with these Terms. It is prohibited to: use the Services for illegal or fraudulent activities; attempt to gain unauthorized access to systems or data; interfere with the availability or security of the Services; redistribute, resell or sublicense access without authorization. Violation may result in account suspension or termination.
5. User Content
The User retains all rights to the data and content they submit to the Services. The User grants WTK Automação a limited license to process, store and display that content only for the provision of the Services. WTK Automação is not responsible for user-generated content. The User and WTK Automação are each responsible for fulfilling their respective tax and accessory obligations arising from the use of the Services.
6. Payment and Termination
Payment amounts, conditions and frequency are defined in the contract or offer accepted by the User. Either party may terminate access or the contract in accordance with the agreed conditions. In case of breach of these Terms, WTK Automação may suspend or terminate access immediately. Upon termination, the right to use ceases and the User must stop using the Services.
7. Prohibited Uses
Users are prohibited from using the Services for illegal purposes, including, but not limited to, money laundering, fraud or financing prohibited activities. Any act that compromises the security, stability, availability, reputation or compliance of the Services is prohibited.
8. Intellectual Property
All software, trademarks, documentation and materials provided by WTK Automação remain the exclusive property of WTK Automação or its licensors, protected by their respective applicable licenses. The User is granted only a limited, non-exclusive, non-transferable license to use the Services during the contracted period. The User does not acquire any rights to the source code or WTK Automação's intellectual property.
9. Limitation of Liability
The Services are offered "as is", without any warranty of any kind, express or implied. WTK Automação does not guarantee continuous availability, absence of errors, specific results or any level of technical performance. Under no circumstances shall WTK Automação be liable for any indirect, incidental, special, punitive damages, loss of data, lost profits or moral damages arising from or related to the use of the Services. Our total liability shall not exceed the amount paid by the User in the twelve months preceding the event giving rise to the claim, except where applicable law does not allow this limitation.
10. Indemnification
User agrees to indemnify and hold harmless WTK Automação, its directors, employees, partners, agents, suppliers or affiliates from and against any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising from or related to their use of the Services or any violation of these Terms.
11. Changes
WTK Automação may adjust functionalities, suspend or terminate the Services at any time. We may, at any time, change, modify or adjust these Terms, in whole or in part. Any modifications that restrict Users' rights will be duly and timely communicated. Continued use of the Services after the publication of changes constitutes acceptance of the new terms. If they do not agree with the changes, Users must discontinue use of the platform.
12. Privacy
The processing of personal data will observe the Privacy Policy, which is an integral part of these Terms.
13. Legislation and Jurisdiction
These Terms and Conditions of Use, as well as the Privacy Policy, are governed by the laws of the Federative Republic of Brazil, including, but not limited to, the Federal Constitution, the Civil Code, the Consumer Defense Code, the Civil Rights Framework for the Internet and the General Data Protection Law (LGPD). The jurisdiction of São José dos Pinhais, State of Paraná, is elected as the only competent to resolve any issues or controversies arising from these Terms and Conditions of Use, with express waiver of any other, however privileged it may be.
